									<content:encoded><![CDATA[<p>Hi Tom! Thanks for responding. Since AZ is a community property state, they don&#8217;t have to file 2 Schedule Cs. There&#8217;s special treatment under Rev. Proc. 2002-69. The issue is with NY from 2018-2020. They both had income in 2018, but since then, it&#8217;s been only the wife.</p>

									<content:encoded><![CDATA[<p>I have new clients who formed an LLC in AZ, where they were allowed to file the income from the LLC as spouses on a Schedule C. They have never filed a 1065. In 2018, they changed the LLC to a NY LLC and continued to report the income on Schedule C. Any suggestions on the best course of action to correct this? <p>I’m definitely not a NH expert, but I had one of these last year. I don’t believe it would be taxable. Line 4 of the DP-10 allows you to list exceptions. Exception 3 is for capital gains and 5 is for liquidating distributions. Exception 10 or even 11 (return of capital) may work for your situation as well, depending on the situation.
